There has been a slew of predictions and guesses on what the prime Minister Dato’ Sri Najib Tun Razak will announce tonight, just ahead of Malaysia Day celebrations tomorrow.
One of it is the scrapping of the Internal Security Act (ISA) that had been the protector against any breach in national security since the 1960s.
One of the speculations can be read here. It stated that:
Datuk Seri Najib Razak could dismantle the Internal Security Act (ISA) as early as this week as he seeks to get some new momentum ahead of a general election expected within a year.
Najib came to power in April 2009 with the promise of reviewing the security law but the prime minister, whose reform credentials are seriously in question after flip-flops, is considering going all the way and abolish the law that allows detention without trial.
Given the severity of the issue and also the changing world environment we are living in, the abolishment of such laws will have a direct and quick impact on the citizens.
If the PM is not likely to scrap the ISA laws, then most likely, there will be some major revamps. It is said that the Home Ministry revise provisions in the Act, with amendments revolving around five areas — the length of detention, rights and treatment of detainees and their families, the powers of the home minister, the use of the ISA for political reasons and detention without trial.
This is quite probable.
In the increasingly dangerous world we live in, it is a miracle that Malaysia had avoided massive upheavals and terrorism acts within our soil.
This country has never been a fertile land for terrorism and strife. People are generally living in peace which, naturally, many are taking it for granted.
When there is a vacuum in our national security laws, if the ISA is revamped or scrapped, most people who shun the ISA opined that we have enough laws to deter any aggression towards our nation; laws such as Emergency Ordinance and the various criminal laws that we have.
But none of them deal with pre-emptive strike. Meaning, it triggers when the damage had been done. More often than not, damages done were so irreparable that the loss caused is too unbearable to bear such as loss of lives, property, peace and stability.
Many nations around the world is dealing with this specific issue; the pre-emptive move to mitigate a catastrophic consequences.
Enter The Patriot Act.
The Patriot Act which was introduced in The United States are more comprehensive and more powerful than our own Internal Security Act.
Given the grim and pessimistic world we live in where terrorism lurks from every nook and cranny, the Patriot Act is an astute law that can nip any terrorism from the bud.
And, given the prejudice of some lawmakers and politicians in this country where whatever the first world democracies are doing, we in this developing world must try our best to emulate, then it is imperative that all politicians, be it from Barisan Nasional or Pakatan Rakyat, see that the ISA must have a better and improved substitute, realistically, the Patriot Act.
Surely we can expect very minimal cries from those who previously had opposed the ISA should Najib wants to create a Patriot Act similar to the United States. Surely Singapore must have done the right thing to have a similar, if not stricter security act of their own. After all, incidentally, those who oppose the ISA here, are great admirers of the US and Singapore administrations.
The USA Patriot Act stands for Uniting (and) Strengthening America (by) Providing Appropriate Tools Required (to) Intercept (and) Obstruct Terrorism Act. It was enacted in end 2001.
It redefines the term “domestic terrorism” to broadly include mass destruction as well as assassination or kidnapping as a terrorist activity.
The definition also encompasses “activities that seek to influence the policy of a government by intimidation or coercion”, and are “dangerous to human life that are a violation of the criminal laws of the United States or of any State” and are intended to “intimidate or coerce a civilian population,” or are undertaken “to affect the conduct of a government by mass destruction, assassination, or kidnapping” while in the jurisdiction of the United States.
All the above activities are termed as ‘TERRORISM’, under the Patriot Act.
Terrorism is also included in the definition of racketeering. Terms relating to cyber-terrorism are also redefined, including the term “protected computer,” “damage,” “conviction,” “person,” and “loss”.
There are several areas which The Patriot Act will cover.
1. Enhancing domestic security against terrorism
2. Surveillance procedures
3. Anti money laundering to prevent terrorism
4. Border security
5. Removing obstacles to investigate terrorism
6. Victims and families of victims of terrorism
7. Terrorism criminal law
8. Improved intelligence
The Act is so powerful that if the Attorney General requests the military to assist him, the military will provide assistance within one official reporting line. Ordinary citiziens’ communications can be tapped, money from bank accounts can be confiscated so on and so forth.
One will not hesitate to guess that The Patriot Act is a very powerful tool indeed. All in the name to fight terrorism activities as enshrined in the definition above.
Although there are many in the US claim that the Act was unconstitutional, its government felt it is still a necessary law to prevent instability in that country. Pre-emptive strike is very critical and could save thousands of lives.
There were hundreds of detainees held in Guantanamo Bay since the introduction of the Act in 2001. Many were held without trial and were subjected to torture and no visitation rights for years. Comparing ISA’s camp in Kamunting and Simpang Renggam to Guantanamo Bay would be like comparing Business class to cargo.
It is hoped the PM will not resort to this kind of brutish treatment although our local admirers of the US regime might vehemently differ.
As a conclusion, the continuity of our nation’s peace and stability is paramount no matter what is at stake and as the US had shown us, even human rights to freedom has to take a backseat when dealing with dangerous elements within the country.
It is hoped that Malaysia will safely chart its course based on the same wisdom and the same experience that had made it relatively one of the most peaceful and successful country ever existed today.
That would be the best gift for Malaysia Day tomorrow.

As long as there is a replacement, perhaps ISA may be repealed. Provided the replacement covers the salient elements and is not a watered down version of the existing ISA – unlike the NEM and the NEP.
The Malays are still reeling with the pangs of the diluting of the NEP in the NEM. And if ISA is replaced with a weaker version, not only the Malays but other right-thinking Malaysians will be disappointed and might express their feelings at the ballot box come GE13.
There cannot be “mengada-ada” or “gatal” attitude on the part of Najib in discarding ISA just for the sake of additional votes. He can’t hope to get many additional votes therefrom. The blokes who are anti-ISA are mainly DAP and they are hardcores, not bothered by the sweets and candies, like the buggers in Rasa who voted DAP in PRK Hulu Selangor despite Najib’s offer of RM3 million to the Chinese school there. And they had the cheek to claim the RM3 million after the elections and Najib had the gall to write the chegue. Ludicrous. Damn.
The fact that what has been touted as the most liberal country in the world passed the Patriot Act after the Nine Eleven debacle shows that stiff measures to control unruly bastards out to create mischief is very much in order. Remember also that the US has ISA-like detention without trial in Guantanamo Bay. They in fact have TWO what blokes here call “draconian” laws to protect the safety and well being of their citizens.
If ISA is repealed, the replacement must be nothing less than the equivalent in effect and force as the old one and preferably as wide ranging in application as the Patriot Act of the US. It must cover visits by communists from China as much as the US Patriot Act hinders Arabs and Asians visiting that country.

You yourself quoted my words “communists from China” and why the hell do you say I imply “every Chinese is a threat to this country”? This is the very example, the very embodiment of you being “blinded by complete hatred for a certain race” such that every time a Malay speaks for the protection of the national interest against communists, you quickly and unthinkingly think it is against your race.
And you show that racist nature being in you again when you said you “like it that … the US treat every Arab as a Terrorist”. You bigoted son of a gun – and do note that a gun needs not be Chinese.
And do remember that concern for communists from China entering this country is very valid because
1. the Communist Party of Malaya was almost entirely made up of Chinese
2. they believed in armed struggle and the overthrow of the government by force and have not renounced that belief
3. Communism is not allowed in this country – friendly relations between governments and government leaders do not negate the fact that communism is anathema to the Westminster kind of democracy that we practice where we have the YDP Agong and the Malay Rulers whose roles and responsibilities are clearly stated in the Constitution.
Communists may visit this country but any word or wind of them thinking or intending to spread the communist ideology while in this country must not be allowed to enter, and those already allowed to enter or already in the country, must be shooed off immediately.

Then you accuse me of “implying that the every Chinese is a threat to this country”. Are you not skewed in doing so? The overwhelming majority of Malaysian Chinese are certainly not a threat. And I have explained at length about communists and MCP in my preceding comment.
Next you you accused me “how much you hate the Chinese.” Were you not looking for trouble in doing so?

Though you asked for a reply by email presumably by JMD, the fact that your comment is printed here suggests that anyone can comment on it.
I certainly think that Malaysians are not ready for life without ISA or its equivalent.
ISA was designed to protect the country against threats to the internal security of the country, hence the name. Those threats take many forms. Sedition can also be a threat but is already covered by the Sedition Act. But subversion is also a serious threat and it also takes many forms. Basically it’s the act of wanting to overthrow the government by other than the democratic means of general elections and the vote. That includes acts and utterances that incite the public to rise against the government in ways that’d cause chaos and disorder, upsetting the internal security of the country, like the racist, inflammatory and incendiary speeches made during the election campaign of 1969 and the DAP election victory celebration convoying through Malay majority areas shouting rude words and showing their private parts that sparked the race riots of 13 May.
It used to be subversion by the communists of CPM. There was evidence that their members also took part in the 1969 riots. They no longer exist as an organization in this country but it is not known whether any of their members still operate individually here. They may also have sympathizers and supporters. DAP Lim Kit Siang has been calling for the CPM leader Chin Peng, who has been verified not being a Malaysian citizen, to be allowed to enter this country. Kit Siang does that because he knows there are many sympathizers of the communist terrorist Chin Peng among the Chinese, especially the DAP. In view of this alone, we Malaysians are not ready to live without ISA.
I hope Malaysia would adopt something like the stringent and wider-ranging Patriot Act of the US. Time permitting, I’ll explain my views another time.

While I agree on the point that we should be civil when it comes to have propoer discussion, there are valid points on what Tempawan said. So, I will try to put my points accross as civil as possible and I hope to receive the same gesture from you as well.
I have always been an anti-ISA proponent. I believe basic human liberty does not involve incarceration without access to the judiciary. As Patrick Henry said “Give me Liberty, or Give me Death!” It goes against the grain of fundamental human right to incarcerate one absolutely without letting one having its day in court. Having such powers makes one person to be “the judge, the jury and the executor” which we all know may be open to abuses. Remember the saying “absolute power currupts absolutely”. Without any check and balance or recourse, any abuse of such power could go unchallenged. eg- reporter whom was detained under ISA. (Since when ISA was enacted to “ensure safety” of a person?)
In respect of the Patriot Act, remember it was enacted after 9/11 incident. It is catered for a totally different scenario-eg terrorism. Guantanamo Bay is filed with foreigners accused of committing terrorism acts against US. No detainees for being having a different political ideology with the current Obama regime, which is what our ISA is used for most of the time.
There is huge difference between a terrorist and being a person having a different political idealogy. Imagine if the Patriot Act being used against the Republicans for refusing to pass the last increase of the budget. Obama could have easliy justified it saying that “it is a threat to the nation if the Bill is not passed as US cannot default on its debt obligations”. Is that what we want? To coerce people to submit to the will of the ruling power?
All in all, there is no place in modern democractic nation to have laws which allows detention without trial. (Singapore is just being an ass to continue to have the ISA). Likewise, I dont think any new laws can be enacted to replace the ISA nilly willy. As it involves a curtailment of fundamental liberties enshrined in the Federal Constitution, I believe a 2/3 majority is required before any such laws can be passed. As we all know, BN doesnt have the numbers to push through such laws. So adios ISA and good riddance..let it be buried in the pages of history.

I must state that the ideal does not exist; it is merely a state of mind. Laws have been made and broken since the beginning of mankind. USA has been touted as the most liberal country in the world yet has ISA-like detention without trial and, since the Nine Eleven fiasco 10 years ago, the stringent and wide-ranging Patriot Act. Despite all the proclamations of liberty, fraternity and justice what have you since the time of their founding fathers..
You need to remember that this country Malaysia has a history of militant communism, belief in the overthrow of government by force, armed struggle they called it. Communist terrorist Chin Peng and the Malayan Communist Party wanted to rule in a system devoid of the Malay Rulers, a Republic, they call it. This is diametrically opposed to the monarchy system of democracy that is reflected in the Constitution which clearly spells out the roles and the responsibilities of the YDP Agong and the Malay Rulers. And more importantly, Chin Peng and the MCP wanted to bring this country under the suzerainty of communist China. Messages between Chin Peng and representatives of communist China and Communist International (Comintern) were intercepted, showing that plan, and these have been documented. Those simply could not be allowed.
The ISA was enacted to deal with such communists whose intention and activities subverted the Constitution and threatened the internal security of the country. The comments by Aku above covered the details of the arguments on the need to maintain the ISA or replace it with a legal instrument of equivalent effect.
I cannot accept that subversive and irresponsible activities that, for example, led to the 1969 race riots do not threaten internal security as much as terrorist acts do. They cause human lives as much as terrorist activities do. In any case, the ISA also covers any form of terrorist acts including religion inspired. I also cannot accept your argument on political ideology differences, coercion, etc. The fact that ISA has been there for ages, the government subscribing to it – including the US which has adopted it in recent years – has been returned to power all these years shows that the majority of the people accept those laws.
Amendments to the Constitution requires a 2/3 Parliamentary majority. Other laws do not.

My immediate response was that I disagreed and I am still is . As I have anticipated many share this sentiment . My reason is simply that ISA is for bad people and I am not the one . We have hundreds of legitimate reasons why ISA should stay . My speculation and much convince that ISA is to stay and I am looking forward to that .
Never mine what I think , let hear what the opposition minds especially the pundits of DAP responded to the announcement , and briefly a touch of my comments .
To have shouldered upon skepticism with consciousness that Najib’s call for the abolition of the Act is just a political ecstasy of diversion from the ‘ long lost democracy. It echoes that Najib is no near of being the ‘ begotten son ‘ of democracy .

you forgot to mention that patriot act has a “sunset clause” which make the law expired without an act of congress or executive.
maybe the government can use this to “test” Malaysian appetite for freedom.
